1. General Provisions
1.1. This Agreement is a public offer (hereinafter referred to as the “Agreement”) in accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine and defines the terms and conditions for the sale and purchase of goods through the online store ‘Lastivka’ (hereinafter referred to as the “Seller”), located at the web address: [specify the store's domain].
1.2. The fact of placing an order by the Buyer on the website means full and unconditional acceptance of the terms of this Agreement.
1.3. The Seller is іndividual entrepreneur [specify the entrepreneur's full name], which carries out economic activities in accordance with the current legislation of Ukraine.
2. Subject of the Agreement
2.1. The Seller undertakes to transfer to the Buyer's ownership flowers, decorative items, accessories, or other products (hereinafter referred to as the “Goods”) presented on the website of the online store, and the Buyer undertakes to accept and pay for such Goods in accordance with the terms of this Agreement.
2.2. Each item of Goods is accompanied by a description, photograph, cost, and delivery terms.
3. Placing an order
3.1. Orders are accepted through the online store website, social networks, or by phone.
3.2. To place an order, the Buyer fills out an electronic form, providing accurate contact information.
3.3. After placing the order, the Seller confirms it by phone or via messenger.
3.4. If the ordered Goods are not available, the Seller informs the Buyer to replace or cancel the order.
4. Price and payment procedure
4.1. Prices for Goods are indicated on the website in Ukrainian hryvnia and are final at the time of placing the order.
4.2. Payment is made in one of the following ways:
- online payment via a secure payment service (Visa/MasterCard);
- cash on delivery (COD) — subject to advance payment of 50% of the order value;
- cash when picking up the order from the store.
4.3. In case of cash on delivery, the remaining amount is paid upon receipt of the order at the post office or to the courier.
5. Delivery of goods
5.1. Delivery is carried out throughout Ukraine:
- In Lviv: courier delivery by taxi services (Bolt / Uklon) daily from 10:00 to 22:00.
- Fast local delivery: free within 5 km of the store.
- Pickup: free at the following addresses:
- Lviv, 226a Kulparkivska St. (shopping center, 1st floor);
- 62 Chervonoyi Kaliny Ave. (near the entrance to Silpo).
- Within Ukraine: Nova Poshta, Ukrposhta — according to the carriers' rates.
5.2. Free delivery is available for orders over 3000 UAH.
5.3. The seller is not responsible for delivery delays caused by force majeure or carrier delays.
6. Returns and exchanges
6.1. In accordance with Article 9 of the Law of Ukraine “On Protection of Consumer Rights,” the Buyer has the right to return or exchange goods of good quality, with the exception of perishable goods (in particular, fresh flowers).
6.2. Returns are only possible for decorative items, accessories, or goods that have not lost their marketable appearance.
6.3. In case of damage to the goods during delivery, the Buyer must notify the Seller on the day of receipt.
7. Quality guarantees
7.1. The Seller guarantees the freshness of the flowers at the time of delivery.
7.2. The duration of the bouquet's preservation depends on the care conditions, which the Buyer receives along with the order.
8. Confidentiality
8.1. The Seller guarantees not to disclose the Buyer's personal data to third parties, except in cases provided for by law.
8.2. The Buyer's data is used exclusively for processing, delivery, and informing about the order.
9. Responsibility of the parties
9.1. The Seller is responsible for the quality of goods and timely delivery within its area of responsibility.
9.2. The Buyer is responsible for the accuracy of the contact details provided.
10. Force majeure
10.1. The parties are exempt from liability in the event of force majeure circumstances (war, natural disasters, emergencies, quarantine, etc.).
11. Final provisions
11.1. This Agreement shall enter into force upon its acceptance by the Buyer (placing an order on the website) and shall remain in force until the Parties have fulfilled their obligations in full.
11.2. All disputes shall be resolved through negotiations, and if this is not possible, through the courts in accordance with the legislation of Ukraine.
